Privacy Policy

1.    Introduction

Basemark Oy is a software development and consultancy company established as a Limited Company in Finland and having a US Limited company, Basemark Ltd. Incorporated in Deleware, USA and a Basemark GmbH in Munich, Germany. (“Basemark” or “we” in this document).

Your privacy is important to Basemark. We also want to be transparent so that you know what information is gathered when you visit our websites basemark.com, gpuscore.com, web.gpuscore.com, and powerboard.gpuscore.com, or when you otherwise use our services or interact with us. We might add new services and offerings that mean changes to this Privacy Policy, too.

3.    Scope and nature of data processing

Please find below a list of situations where we may process your personal data, and further information about other data that we may collect when offering you our website and other services:

3.1  Basemark.com and gpuscore.com websites, newsletter and web forms

Basemark doesn’t collect any personal data through our corporate website, unless you submit a web form, for example by subscribing to our newsletter or downloading a presentation. By sending your personal information through the contact form you give your consent to process it. This information is stored both on the server where the website is hosted (Pressable) and on the Hubspot CRM tool, hosted by Hubspot. Hubspot’s data is hosted in the US. You can unsubscribe to the newsletter anytime by clicking the unsubscribe link in the newsletter itself.

3.2 Third-Party Data

We may obtain information about you from third-party sources, such as public sources, social media platforms (like Instagram, LinkedIn, X and other platforms) and third-party data providers and information services. Some of these providers may combine data collected from our Service through cookies, pixels, tags and similar technologies, with email or mailing addresses to which they have access to help us serve relevant offers to you. Examples of the information we may obtain from such third parties include your company, company size, job title and seniority, industry and other profile information.

3.3 Powerboard benchmarking sites and mobile apps

Basemark doesn’t collect any personal data through the Powerboard.gpuscore.com website.  Through the usage of the graphics benchmarks, such as GPUScore, Basemark Metal Free, Basemark GPU, Basemark OS II or Basemark OS II Free, the user agrees that in some particular cases, the IP data may be collected, as presented and detailed in the Legal Interest Assessment document. The document is available on request via e-mail.

3.4 Basemark Rocksolid Studio and Keygen digital rights management

Basemark uses Keygen LLC’s Keygen ® digital rights management service as part of Basemark Rocksolid Studio. The service is used to create and manage customer accounts, deliver and administer software licenses to business customers, verify license validity and enforce applicable license terms.

For these purposes, we may process personal data such as email address, first and last name, company or group affiliation, license key, license policy and expiry, license status and, where needed for license enforcement or support, machine fingerprint data and the latest heartbeat timestamp. Depending on the features used and the customer’s choices, we may also process technical and usage-related data such as operating system or platform, application version, download events, IP address, hostname or computer name, country or region derived from IP address, usage metrics and customer-specific metadata.

Processing is based primarily on the performance of a contract and our legitimate interests in administering customer relationships, securing our software, preventing abuse and enforcing license terms. Where any optional analytics or similar non-essential processing requires consent under applicable law, we will rely on consent for that processing. Keygen acts as Basemark’s processor for the personal data processed through the service, and Basemark has a data processing agreement with Keygen covering the processing of personal data on Basemark’s behalf. Keygen uses AWS as the underlying hosting infrastructure, and some of the servers used for the service are managed through Heroku.

Personal data processed through Keygen is retained for the duration of the relevant customer contract and for 6 months thereafter, unless a longer retention period is required by applicable law or necessary for the establishment, exercise or defence of legal claims. Keygen is a third-party service provider established in the United States. Data processed through Keygen may therefore be transferred outside the EEA, in which case Basemark relies on the European Commission’s Standard Contractual Clauses as the transfer mechanism.

3.5 Basemark Rocksolid and videos

As part of our automotive product development and testing, we may shoot videos on public roads. These videos may include number plates of vehicles in the traffic or people’s faces. That isn’t intentional and cannot be avoided. We don’t process or share that personal data with any external parties and delete it after 15 years.

Before publishing any video that includes car plates or people’s faces, we’ll blur them first.

3.6 Cookie notice

The default setting of Basemark.com, gpuscore.com, web.gpuscore.com, and powerboard.com websites is “Cookie disabled”, which means that we don’t place any third party or marketing cookies in your web browser. By clicking “Enable”, you allow us to place some basic statistical and profiling cookies in the user’s browser, such as Google Analytics.  If you choose “Keep disabled”, we store only the minimum technical information that is needed to deliver the website and the ranking service for you.

3.7  Partner and visitor data

If you are a business partner of Basemark or visit our office, we save and process following data to be able to perform our contractual duties (GDPR Art.6 a and c). This information contains usually name, e-mail, company name, company address, and telephone number. Invoicing information we collect only if the business relationship requires it.

3.8 Recruiting and employment data

If you send us an application per email or other channels, and a dialogue about possible employment starts, we store the messages and attachments for the purpose of employment negotiations. Those messages usually include name, contact details and information about education and work experience.

To fulfill our contractual duties as an employer (GDPR Art.6 a and c), we store and handle carefully all needed employment data, such as social security number, bank account number, phone number, email address and home address.

3.9 Whistleblower channel

To fulfil the EU legal requirements about whistleblowing, Basemark is using an external service that can be reached here. We collect and process personal data only to the extent that it is necessary for meeting the obligations of the whistleblowing process and the related legislation.

As a rule, the personal data processed is collected from the person submitting the report. The Privacy Policy for our Whistleblowing Channel is available here.

4. Consent

If you have given your consent to us for processing your personal data, please note that you may withdraw this consent at any time. Also other rights arising from the GDPR are fully followed by Basemark, especially the requirement to report a potential breach within 72 hours.

On this website we use first or third-party tools that store small files (cookie) on your device. Cookies are normally used to allow the site to run properly (technical cookies), to generate navigation usage reports (statistics cookies) and to suitable advertise our services/products (profiling cookies). We can directly use technical cookies, but you have the right to choose whether or not to enable statistical and profiling cookies.
